(“Essity”, “we” or “us”) 

Welcome to the LymphConnect website (the "Site"). Please review the following terms and conditions that govern your use of our Site. Please note that your use of our Site constitutes your agreement to follow and be bound by the Privacy Policy, these Terms of Use and this Legal Disclaimer (collectively, the "Terms"). If you do not agree to be bound by the Terms, do not use the Site.

The Site is an online general information service where you can obtain information about the medical conditions lymphoedema and lipoedema. Registered users can communicate with other registered users. The Site is provided by Essity and is available subject to your compliance with the Terms.  You must be at least 18 years of age to use the Site.

The Site does not offer medical advice or medical services. In a medical emergency where you are seriously ill or injured and your life is at risk, call 999 or make your way to your local accident and emergency department. If you do not need immediate medical attention call 111 or consider other options including visiting or calling your general practitioner or talking to a pharmacist.

When using particular services or features of the Site, including downloading content from the Site, both these Terms and a separate contract, terms of use (such as the Site User Terms of Use or Healthcare Provider User Terms of Use), or a similar agreement (collectively, "Additional Terms") may apply to your use of that service or feature. To the extent there is a conflict between these Terms and any Additional Terms, the Additional Terms will control unless the Additional Terms expressly state otherwise.

1. Essity, its affiliates and the Site do not provide medical advice

The Site includes all materials that comprise or are otherwise a part of the Site (including past, present and future versions of the Site), including, without limitation: graphics; layout; text; instructions; images; graphs; charts; trademarks, logos, service marks; software (including HTML-based programs); audio; animations; videos; designs; technology; applications; artwork; information; data; reports; designs; compilations; advertising copy; domain names; any and all copyrightable material (including source and object code); the "look and feel" of the Site; the compilation, assembly and arrangement of the materials of the Site; and all other materials related to the Site (collectively, "Content"). The Content may include general health information or medical-related information, which is provided for general information and educational purposes only. The Content is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Essity and its affiliates do not directly or indirectly practice medicine or any other licensed profession, and they do not interfere with the practice of medicine or any other licensed profession by healthcare providers, each of whom is responsible for his or her services and compliance with the requirements applicable to his or her profession and license. No representation or warranty is made by Essity or its affiliates that any particular device or treatment is safe, appropriate, or effective, and neither Essity nor its affiliates endorse or advocate any treatment method. Your use of the Site and these Terms do not establish any medical professional/patient relationship with Essity or its affiliates.  Neither Essity, its affiliates nor any other third parties who promote Essity’s services shall be liable for any treatment or professional advice you obtain from a healthcare provider via the Site. You should always seek the advice of your qualified healthcare professional with any questions regarding a medical condition.  Never disregard professional medical advice or delay in seeking it because of something you have read on the Site! 

Essity and its affiliates do not recommend or endorse any specific tests, healthcare provider, procedures, opinions, or other information that may be mentioned on the Site. Reliance on any information provided by Essity, its affiliates or their respective employees, others appearing on the Site at the invitation of Essity, or other visitors to the Site is solely at your own risk.

The Site may contain health or medical related Content that is sexually explicit. If you find these materials offensive, you may not want to use our Site.

2. Using the Content on Our Web Site

Unless otherwise noted, all Content (as defined above) on the Site and all copyrights, trademarks, service marks or other intellectual property or proprietary rights contained therein are owned or licensed by Essity or its affiliates. You may use the Content only for limited, internal, non-commercial, informational purposes. You may print out a single copy of the Content solely for those purposes, if the copy bears all copyright, trademark, service mark and other intellectual property and proprietary notices displayed on the Site. You may not distribute, publish, transmit, modify, create derivative works from, or in any way exploit, any of the Content, in whole or in part, for any purpose. Under no circumstances are you being granted a license for any copyright, trademark, service mark, patent or other intellectual property or proprietary right in the Content. If you print out a copy of the Content in breach of these Terms, your right to use the Site will cease immediately and you must, at the option of Essity, return or destroy any copies you have made. Under no circumstances will you obtain any rights in the products, services, processes, or technology described in the Content. All those rights are retained by Essity, its affiliates and any third-party owners of those rights.
The Site is directed to people residing in the United Kingdom and Republic of Ireland. No representation or warranty is given by Essity or its affiliates that the Content available on or through the Site is appropriate for use or available in other locations.

3. Ownership of content

The Content is owned by or licensed to Essity and are protected from unauthorized use, copying and dissemination by copyright, trademark, patent, and other laws, rules, regulations, and treaties. Except as expressly set forth in these Terms or expressly granted to you in writing by Essity, no rights in the Content (whether by implication, estoppel or otherwise) are granted to you. You acknowledge that you do not acquire any ownership rights in the Content by using the Site. You may only use the Content as expressly set forth in these Terms. Unauthorized use, copying, reproduction, storing, modification, republishing, uploading, downloading, posting, transmitting, distributing, duplicating, removal or alteration of advertising, or any other misuse of any of the materials is strictly prohibited. 

Subject to your strict compliance with these Terms, Essity grants you a limited, personal, non-exclusive, non-commercial, revocable, non-assignable and non-transferable license to access and view the Content (excluding source and object code, other than as made available to access and use via standard web browsers to enable display on your device). When you access or view the Content, you must: (a) keep intact all copyright and other proprietary notices; (b) make no modifications to the Content; and (c) not copy or adapt any object code associated with the Site, reverse engineer, modify or attempt to discover any source code associated with the Site, nor allow or assist any third party (whether or not for your benefit) to do so. If you publish a paper based in whole or in part of the Site, Content or research conducted on or through the Site, you agree to cite the Site, including the URL to the Site, in your publication. 

You agree to abide by any and all copyright notices, information, or restrictions contained in any part of the Site. Any and all rights to use the Site that are not expressly granted to you under these Terms are reserved for Essity or its licensors. Nothing contained in these Terms will affect, impair, or limit in any way Essity's rights to exploit fully any or all of the Content. Unauthorized use of Content may be a violation of law and could result in civil and criminal liability. 

4. Prohibited conduct

You agree that you will not, including without limitation by use of any robot, scraper or other data mining technology or process, frame, mask, extract data or other materials from, or copy or distribute, the Content (except as may be a result of standard search engine or Internet browser usage). Except as expressly provided in these Terms, you may not copy, reproduce, republish, modify, create derivative works of, upload, download, perform, display, post, transmit, distribute or otherwise use, the Content in any way, without the prior written permission of a duly authorized Essity employee. You may not violate any instructions or restrictions communicated to you by Essity on or through the Site. 

You agree not to violate or interfere with the security of the Site, attempt to gain unauthorized access to the Site or data, materials, information, computer systems or networks connected to any server associated with the Site, through hacking, password mining or any other means, or otherwise bypass or circumvent any measure employed to limit or prevent access to the Site or Content. You also agree not to take or attempt any action that, in the sole discretion of Essity, imposes or may impose an unreasonable or disproportionately large load or burden on the Site or Essity’s infrastructure. You agree not to use the Site to determine the identity of any specific individuals contained in any video. You further agree not to use the Site for any unlawful purpose. 

You may only use the Site for lawful purposes. You may not use the Site in any way that violates any applicable local, national, or international law or regulation or in a way that is fraudulent.

5. Membership and registration

Use of the Site, or certain areas of the Site, may require registration or may otherwise ask or require you to provide information to use certain services or features. Any membership you may establish on the Site is also governed by any applicable Additional Terms, including the Site User Terms of Use or Healthcare Provider User Terms of Use. When you choose to provide information to the Site, you agree to provide only true, accurate, current, and complete information. If you register with us, you agree to be responsible for any activities that occur under your account or password, and you agree you will not sell or otherwise transfer your membership or any membership rights.

Essity reserves the right to review your registration before permitting access to the Site, to deny access to the Site, and to terminate your access to the Site, for any reason or no reason, in its sole discretion without notice and without liability. You also agree to comply with all rules, laws and regulations that are applicable to your use of the Site, including, without limitation, those governing transmission or use of any software or data. 

6. Issuance of passwords

Access to and use of password-protected areas of the Site is restricted to authorized users only.  When these Site User Terms of Use have been accepted and agreed to by you, the password that you create will soon be activated to enable you to access the Site.  Passwords may not be shared or used by more than one individual.  It is each individual user’s responsibility to remember and protect such password and not to disclose it to any other person.  Remember to choose a strong password, including numbers, capital letters, special characters, etc., that is not typically found in a dictionary. Neither Essity nor its affiliates are responsible for any unauthorized access to your account.

7. Lost passwords

In the event your password is lost or stolen it is your responsibility to notify Essity at the address listed in the Contact Us section.  You can reset your password at any time by using the “password reset” at the Site.

8. Retention of data

Except to the extent any shorter period is set out in the Privacy Policy, the Site will retain your data for as long as is necessary for the processing purpose(s) for which they were collected and any other permitted linked purpose unless:

  • You terminate your account with the Site
  • Your account is terminated in accordance with the process described below

Essity and its affiliates will retain your data for as long as is necessary for the processing purpose(s) for which they were collected and any other permitted linked purpose (for example certain correspondence may be retained in order to comply with regulatory requirements regarding retention of such data). In each case, Essity and its affiliates will retain the aggregate (consolidated) information that may include anonymized information, such as “Over the past 12 months, X number of users visited this page, and uploaded a photo.”  Note that Essity and its affiliates may be required to retain and disclose your information as described in the Privacy Policy.

9. Non-use of account 

If there has been no activity on your account for 24 consecutive months, Essity will contact you via the e-mail address you provided.  In the event that you do not reply within 15 business days, Essity will terminate your account.

10. Account termination

You agree that Essity may suspend or terminate your account or access to the Site with or without notice or cause, for any reason or no reason, and without liability to you.

You may terminate your account at any time by selecting the “Unregister” button.  If you confirm that you wish to leave the Site, any comments in the Community will remain visible to all users of the community features such as message boards.  In addition, the Site will generate an e-mail to each healthcare provider user to which you are connected as of the date of termination of your account, letting the healthcare provider user know that you have terminated your account.  Note that you may elect to stop sharing data with a healthcare provider user at any time without terminating your account.

11. Marketing consent

Essity, BSN Medical Limited and its affiliates will market goods and services to you only in accordance with your marketing consent. You can withdraw your consent to, or opt back into, the receipt of such communications at any time through the privacy dashboard in your profile or by contacting the LymphConnect team. Full details of how we use your information are in our Privacy Policy.

12. User content, license to Essity

The Site may provide you and other users the opportunity to submit, display or post to the Site a variety of information, content, or media, including images and text (collectively, "User Content"). User Content may be supplied by site users and/or healthcare provider users.  Neither Essity nor its affiliates control the User Content made available via the Site and therefore they do not guarantee the accuracy, integrity, or quality of any User Content. 

13. Responsibility for user content

You understand that you are solely responsible for your User Content, however submitted. You agree that your User Content complies with the User Submission Policy set forth below and does not contain any content that: libels, defames, invades or violates the privacy of another person, or is indecent, obscene, pornographic, abusive, or threatening (in Essity’s sole discretion); infringes any intellectual property right of any entity or person, including, but not limited to, violating copyrights or trademarks or any right of publicity, or otherwise violates any law. Essity assumes none, and you assume all, responsibility or liability arising from or related to any User Content submitted to or posted to the Site, including responsibility or liability for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information you submit to or post to the Site. 

Neither Essity nor any of its affiliates have any obligation to monitor the Site or any User Content made available via the Site. However, you acknowledge and agree that Essity and its affiliates have the right to monitor the Site and User Content you provide and the right (but not the obligation) to delete, edit, move, or disable any such User Content in whole or in part subject to Essity's sole discretion. Essity reserves the right to suspend or terminate your access to the Site at any time. Under no circumstances will Essity or its affiliates be liable in any way for any User Content, including, but not limited to, any errors or omissions in your User Content, any loss of your User Content or for any loss or damage of any kind incurred as a result of your User Content. 

14. License to Essity

Your User Content, whether submitted via the Site or otherwise to Essity, will be treated as non-confidential and non-proprietary and Essity will not be liable for any use or disclosure to anyone, including but not limited to claimed intellectual property owners. You remain the owner of your User Content, but, when you make a submission, you automatically grant to Essity a worldwide, non-exclusive, assignable, royalty-free, perpetual and irrevocable right and license (including the right to grant sub-licenses) to use, modify, adapt, copy, display, disclose and create derivative works based upon your User Content (including without limitation any and all intellectual property and proprietary rights in such User Content) for the purpose of providing and supporting the services, functionality and features of the Site, and administering, improving or enhancing the Site, and for Essity’s and its affiliates internal purposes.  You acknowledge that Essity may be working on or developing material similar or the same in nature to your User Content and that Essity may have received similar or the same intellectual property rights from another party. Essity and its affiliates owe you no obligation with respect to your User Content unless you and Essity enter a written agreement to that effect. If your User Content is subject to protection under intellectual property rights laws, you are responsible for seeking and securing any such protection that may be available to you. Any discussions or negotiations between you and Essity or its affiliates regarding your User Content do not constitute Essity's or its affiliate’s recognition of the novelty or originality of your User Content.  

You agree and understand that neither Essity nor its affiliates are obligated to post or use your User Content submitted through the Site or otherwise and may alternatively choose to discard or remove your User Content without any liability whatsoever. You agree that Essity and its affiliates have no obligation to monitor or enforce your intellectual property rights to your User Content. 

15. User Content Requirements

When you contribute, upload, or otherwise provide your User Content to the Site, you agree to comply with the following requirements: 

  1. User Content must be your own or in the public domain. All User Content must be created by you and you must have all rights in the User Content; or, all persons who contributed in any way or have any rights to your User Content, or otherwise appear in the User Content, must have given you permission to upload and distribute the User Content on the Site and elsewhere. You may also upload content that is in the public domain. Upon Essity's request, you will furnish Essity any documentation, substantiation or releases necessary to verify your compliance with these Terms.
     
  2. No third-party materials. Your User Content should not contain any visible logos, phrases or trademarks or other third-party materials. Do not use any User Content that belongs to other people without their permission – this means you absolutely may not include any content owned or created by someone else unless you have secured the right to do so, including no uploading or copying of content you found elsewhere on the Internet without proper permission. 

  3. No illegal or objectionable content. Your User Content must not violate any law. Your User Content may not promote any illegal activity.  User Content may not promote violence or sexually explicit material. Your User Content must not contain any material which is obscene, offensive, hateful, or inflammatory. Your User Content must not threaten, abuse, harm or cause annoyance, inconvenience, or needless anxiety to others or defamatory of others. Your User Content must not promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.   

  4. No third-party personal information. Your User Content may not reveal another person's address, phone number, e-mail address, credit card number or any information that may be used to track, contact, or impersonate that individual, or that is personal in nature.

  5. No User Content for commercial purposes. Your User Content may not advertise or promote a product or service. You may not use your User Content to raise money for anyone or for a pyramid or other multi-tiered marketing scheme.

  6. Do not damage the Site or anyone's computers. User Content may not contain viruses, Trojan horses, spyware, or any other technologies that could impact the operation of the Site or any computer system.

If you do upload or post User Content that violates these Terms, Essity reserves the right to take any action that Essity deems appropriate, which may include, in Essity’s sole discretion, reporting you to law enforcement. In cases where you feel threatened or believe someone else is in danger, you should contact your relevant law enforcement agency immediately. 

16. Access to Site and electronic communications

You are responsible for obtaining access to the Site, and that access may involve third-party fees (such as Internet service provider or airtime charges). In addition, you must provide and are responsible for all equipment necessary to access the Site. You may not bypass any measures that have been implemented to prevent or restrict access to this Site. Any unauthorized access to the Site by you (including any such access or use that involves in any way an account you may establish on the Site or any device you may use to access the Site) shall terminate the permission or license granted to you by Essity.

When you use the Site or send emails to Essity, you are communicating with Essity electronically. You consent to receive electronically any communications related to your use of this Site. Essity will communicate with you by email or by posting notices on this Site. You agree that all agreements, notices, disclosures, and other communications that are provided to you electronically satisfy any legal requirement that such communications be in writing. All notices from Essity intended for receipt by a customer shall be deemed delivered and effective when sent to the email address you provide on any of the Essity Sites.

17. Copyrights and other intellectual property and related complaints

You may not use the Site for any purpose or in any manner that infringes the rights of any third party. Essity encourages you to report any Content on the Site that you believe infringes your rights.  Only the intellectual property rights owner or person authorized to act on behalf of the owner can report potentially infringing content. If you have a good faith belief that content on the Site infringes your copyright, trademark, or other intellectual property rights, please follow the procedures set forth below. 

18. User interactions and disputes

You are solely responsible for your interaction with other users of the Site, whether online or offline. Neither Essity nor its affiliates are responsible or liable for the conduct of any user. Essity and its affiliates reserve their rights, but have no obligation, to monitor or become involved in disputes between you and other users. Exercise common sense and your best judgment in your interactions with others, when you submit or post any personal or other information, and in all other online activities. 

19. Your information must be accurate

You may not use a false email address or other identifying information, impersonate any person or entity, or otherwise mislead as to the origin of any content. Some features that may be available on this Site require registration. By registering, you agree to provide true, accurate, current, and complete information about yourself.

20. Reporting illegal or inappropriate Content

If you observe any inappropriate or illegal Content (including without limitation such Content displayed in images, including those made available by third parties) on the Site, you agree to report that Content to Essity using the contact information made available on the Site. Inappropriate or illegal Content includes, but is not limited to, images depicting (i) an area where a person is reasonably likely to disrobe (including restrooms, baths, showers, and dressing rooms), (ii) child pornography, (iii) criminal acts or other crimes, and (iv) copyrighted content that the person posting the image is not authorized to display. In addition, you may be required to report to relevant law enforcement agency illegal activities you observe on the Site. You, and not Essity or its affiliates, are solely responsible for compliance with any laws that require the reporting of illegal activities to relevant law enforcement agency, even if you report that illegal activity to Essity. 

21. Disclaimers and liability

The Site and the Content are provided "as is," and without warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, Essity and its affiliates disclaim all warranties, express or implied, including implied warranties of quality and fitness for purpose.

Without limiting the foregoing, neither Essity nor its affiliates warrant or guarantee that your use of the Site will be timely, uninterrupted, error-free, or secure, that defects or errors will be corrected, or that the Site (or the server(s) that makes the Site available) is free of viruses, malware or other harmful components.  You assume total responsibility and risk for your use of the Site and your reliance thereon. 

Further, neither Essity nor its affiliates warrant or guarantee that your activities, or use of the Site, are lawful in any particular jurisdiction and, in any event, Essity and its affiliates specifically disclaim such warranties. 

You understand that by using any of the features of the Site, you act at your own risk, and you represent and warrant that your activities are lawful in the jurisdiction where you access or use the Site. 

Essity and its affiliates do not exclude or limit in any way its liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by the negligence of Essity or its affiliates or the negligence of their respective employees, agents, or subcontractors and for fraud or fraudulent misrepresentation. Subject to the foregoing, in no event shall Essity or its affiliates be liable for any loss of profit, loss of business, business interruption, loss of business opportunity or any consequential loss or damages, in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with use or inability to use the Site or use or reliance on any Content. Please remember that it is your responsibility to evaluate the accuracy and reliability of any Content. Although Essity makes reasonable efforts to update the information on our Site, the Content may include inaccuracies or errors.  Additionally, a possibility exists that unauthorized alterations could be made to the Site by third parties. Neither Essity nor its affiliates warrant or guarantee the functionality or the performance of the Site nor that the Site will be secure or free from viruses. You are responsible for configuring your information technology to access the Site and you should use your own virus protection software.

Essity and its affiliates shall be excused from performance under these Terms to the extent Essity or its affiliates are prevented from or delayed from performing, in whole or in part, as a result of an event or series of events caused by or resulting from (1) weather conditions or other elements of nature or acts of god, (2) acts of war, terrorism, insurrection, riots, civil disorders, or rebellion, (3) quarantines or embargoes, (4) labour strikes, or (5) other causes beyond the reasonable control of Essity and its affiliates. 

22. Indemnification

You agree to indemnify, defend and hold harmless Essity and its affiliates, including without limitation, their direct and indirect subsidiaries, supporting organizations, their predecessors and successors to any interest, their licensees, distributors and assignees, and the officers, trustees, directors, shareholders, members, agents, representatives, employees, and suppliers of each of them (each, as used throughout these Terms, a "Essity Indemnified Party" and, collectively, the "Essity Indemnified Parties"), from and against any and all claims, demands, damages, losses, investigations, liabilities, judgments, settlements, costs (including lawyers' fees), or other expenses that directly or indirectly arise from or are otherwise directly or indirectly connected to: (a) your breach of these Terms; (b) your violation of any law, rule, regulation, code, statute, ordinance or order of any governmental and quasi-governmental authorities, including, without limitation, all regulatory, administrative and legislative authorities; (c) information or material transmitted through your computer, even if not submitted by you, that infringes, violates or misappropriates any copyright, trade mark, trade secret, trade dress, patent, publicity, privacy or other right of any person or defames any person; (d) any misrepresentation made by you; or (e) the Essity Indemnified Parties' use of your information as permitted under these Terms or any other written agreement between you and Essity. You will cooperate as fully required by the Essity Indemnified Parties in the defence of any claim. Essity reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, and you will not in any event settle any claim without the prior written consent of a duly authorized employee of Essity. 

23. Links to third party content

The Site may provide links to certain websites, videos, services, and features that are provided by third parties. Functionality on the Site may also permit interactions between the Site and a third-party website or online feature, including functionality that allows you to connect the Site or your profile on the Site with a third-party website. For example, the Site may include features enabling you to indicate on a third party website or service that you “like” certain Content, to share Content on a third party website or service, to log-in to the Site using your username and password for a third party website or service, to transmit content to the Site from your account on a third party website or service, and to otherwise connect the Site to a third party website or service. Using this functionality may require you to login to your account on the third-party website, and you do so at your own risk. 

Essity and its affiliates do not monitor or have any control of these third-party websites or services, or any of their content. Accordingly, you understand and agree that neither Essity nor its affiliates approve, endorse, sponsor or recommend and is not responsible for your use of these third party websites or services, and that your use of such websites, streams, or services is subject to the terms and conditions established by such third parties. Essity reserves the right to terminate a link to a third-party website at any time.  The third-party websites may have different terms of use and privacy policies, which Essity encourages you to review.  Your correspondence and business dealings with third parties found through the Site including, without limitation, the payment and delivery of products and services, and any terms, conditions, warranties and representations associated with any such dealings, are solely between you and the third party. 

Descriptions of, references to, or links to products, services or publications within the Site do not imply our approval, endorsement, sponsorship or recommendation of that product, service, or publication. 

24. Linking policy

Essity grants you the revocable permission to link to the Site; provided, however, that any link to the Site: (a) must not present false information about, disparage, damage, dilute or tarnish the goodwill associated with Essity or its products or services, any Essity property or any other intellectual property; (b) must not create the false appearance that your website or organization is sponsored, endorsed by, affiliated or associated with Essity or its affiliates; (c) must not frame or create a browser or border environment around any of the Content on the Site or otherwise mirror any part of the Site; (d) must not use any Essity trademarks without the prior written permission from Essity; (e) must not contain content that could be construed as distasteful, offensive or controversial or otherwise objectionable (in Essity's sole opinion); and (f) must be owned and controlled by you or the person or entity placing the link, or otherwise permit you to enable such link subject to these Terms. You agree that you will not link to the Site from any source that is unlawful, abusive, indecent or obscene, that promotes violence or illegal acts, that contains expressions of racism, that is libellous, defamatory, scandalous, or inflammatory or is otherwise inappropriate (in Essity's sole discretion). By linking to the Site, you agree that you do and will continue to comply with the above linking requirements. 

25. Termination

Essity reserves the right, without notice or liability and at its sole discretion, to suspend or terminate these Terms and/or your ability to access or use the Site (or any portion of the Site), and to block or prevent future access to and use of the Site for any reason, including, without limitation, your breach of these Terms or other conduct by you that Essity considers inappropriate. Essity reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Site with or without notice. You agree that neither Essity nor its affiliates shall be liable to you or to any third party for any modification, suspension, or discontinuation of the Site. You acknowledge and agree that termination, suspension, or cancellation of these Terms or your access to the Site will not affect any right or relief to which Essity or its affiliates may be entitled, at law or in equity, nor shall they affect any obligation you have to Essity, including but not limited to the payment of fees. 

Upon termination of these Terms, all rights granted to you will automatically terminate and immediately revert to Essity and its licensors. Upon termination of your access to the Site, or upon demand by Essity, you must destroy all copies of Content and all related documentation and immediately discontinuing the use of any links to the Site. Any provisions of these Terms, which, by their terms, ought to survive, shall survive any termination of these Terms. 

Any breach of these Terms by you may be referred to law enforcement authorities. 

26. Privacy policy

Your use of the Site and communications with Essity are governed by and subject to the Privacy Policy which sets out the terms on which we process personal data we collect from you, or that you provide to us. You acknowledge that you have read our Privacy Policy, and that any personal data we collect from you will be processed in accordance with the Privacy Policy. You warrant that all data provided by you is accurate.

27. Entire agreement

You acknowledge and agree that these Terms and any applicable Additional Terms constitute the complete and exclusive agreement between you and Essity concerning your access to and use of the Site, and supersede and extinguish all prior agreements, promises, assurances, warranties, representations and undertakings between us, whether oral or in writing, with respect to the Site. Neither party has any remedies in respect of any statement or representation not set forth in these Terms and any applicable Additional Terms. You agree that neither party shall have any claim for innocent or negligent misrepresentation based on any statement in these Terms and any applicable Additional Terms.

28. Rights of third parties

Except as provided in this paragraph 20, a person who is not a party to these Terms shall have no rights pursuant to the Contracts (Rights of Third Parties) Act 1999 to enforce rights or benefits under these Terms. In addition to Essity, each other affiliate and other Essity Party may enforce paragraph 19, any limitation or exclusion of liability in favour of Essity, any warranty or indemnity in favour of Essity, and any other right or benefit expressly conferred by this Agreement on any affiliate or other Essity Party.

29. Miscellaneous

If any of the provisions set forth in these Terms or the Additional Terms are deemed invalid, void, or for any reason unenforceable, the parties agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and the unenforceable condition shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions of these Terms or the Additional Terms. These Terms and any rights herein, if any, are not assignable, transferable or sublicensable by you except with the prior written consent of a duly authorized Essity employee. Essity may assign these Terms and any rights contained herein without your prior notice or consent. No failure or delay by either party to exercise any right or remedy provided under these Terms or the Additional Terms shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall prevent or restrict the further exercise of that or any other right or remedy. Any heading, caption or paragraph title contained in these Terms are inserted only as a matter of convenience and in no way defines or explains any paragraph or provision hereof. Any words following the terms: including, include, in particular, for example or any similar expression, shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase, or term preceding those terms. Nothing contained in these Terms shall be construed as creating a partnership between you and Essity nor shall it constitute you the agent of Essity for any purpose or authorise you to enter into any commitments for or on behalf of Essity. You agree that these Terms will not be construed against Essity by virtue of having drafted these Terms. 

The Site is directed to people residing in the United Kingdom and the Republic of Ireland. No representation or warranty is given by Essity or its affiliates that the Content available on or through the Site is appropriate for use or available in other locations. You are responsible for informing yourself of the laws of other locations and complying with them.

30. Changes to these terms

We reserve the right, in our sole discretion and at any time, to change or add to the terms of these Terms without prior notice ("Updated Terms"). You agree that we may notify you of the Updated Terms by posting them on the Site so that they are accessible via a link from the home page.  Therefore, whenever you want to use the Site you should review these Terms before using the Site.  The Updated Terms will be effective as of the time of posting, or such later date as may be specified in the Updated Terms and will apply to your use of the Site from that point forward.

31. Governing law

These Terms, their subject matter, formation, and performance shall be governed by English law. The courts of England and Wales shall have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in in the courts of Northern Ireland, if you are a resident of Scotland, you may also bring proceedings in the Scottish courts and if you are a resident of the Republic of Ireland, you may also bring proceedings in the Irish courts.
